Which mortgages can a buyer assume?
Quick answer: Mainly FHA and VA loans. FHA rules (24 CFR 203.512) bar lenders from restricting assumptions, though the buyer must be creditworthy and occupy the home. VA loans committed on or after March 1, 1988 can be assumed with approval if the loan is current and the buyer qualifies (38 U.S.C. 3714). Most other loans have enforceable due-on-sale clauses.

FHA assumptions
- Free assumability. Under 24 CFR §203.512(a), an FHA lender may not impose or enforce restrictions on assuming the insured mortgage unless HUD's rules allow it.
- Credit review. Where approval is required, the lender may not approve the transfer unless at least one person acquiring ownership is creditworthy under HUD standards (§203.512(b)).
- Occupancy. The lender may not approve a transfer to someone who can't qualify because the home won't be a primary residence or a permitted secondary residence (§203.512(c)), so investors can't assume.
- Due-on-sale. Every FHA mortgage carries a due-on-sale clause, enforced if the home is sold without approval when these rules apply (§203.512(d)).
VA assumptions
- Approval required. For VA loans committed on or after March 1, 1988, the loan can be assumed only with approval. The loan must be current, and the buyer must qualify on credit (38 U.S.C. §3714).
- Seller release. When the assumption is approved under §3714, the seller is released from liability on the loan.
- Entitlement. Under 38 U.S.C. §3702(b), a seller's VA entitlement can be restored when a qualifying veteran buyer substitutes their own entitlement. If the buyer isn't a veteran, the seller's entitlement can stay tied to the loan, which matters to a veteran seller who wants to buy again with VA.
- Funding fee. VA charges a fee of 0.50% of the unpaid balance on an assumption (38 U.S.C. §3729).
Why other loans usually can't be assumed
Most conventional mortgages include a due-on-sale clause, and federal law (12 U.S.C. §1701j-3, the Garn-St Germain Act) lets lenders enforce it. The law lists exceptions where a lender can't call the loan, such as a transfer to a relative after the borrower's death, a transfer where the borrower's spouse or children become owners, a divorce decree, or a transfer into the borrower's living trust. Those protect families, not buyers on the open market.
The equity gap
Assuming a loan covers only its unpaid balance. If a home sells for more than that, you need to bring the difference, either in cash or with additional financing, plus closing costs. That's often the deciding factor, and it's where a lender's review is worth having before you make an offer.
How to find assumable homes in Arizona
- Ask the listing agent which loan type the seller has (FHA or VA), when it was made, and the current balance.
- Get the servicer's assumption requirements and timeline in writing; the servicer, not the seller, approves the assumption.
